This document outlines
the contractual agreement between Appletree Property Services; hereafter
referred to as the “provider”, and the customer; hereafter referred to as the
“purchaser” of services and/or materials bought from Appletree Property
Services.
I.
Definitions
a.
Budgetary Quotation – A preliminary contract
based on the initial site visit.
b.
Final Quotation – A final contract based on
the most accurate information the Provider has gathered, including any
changes required by the Purchaser from the Budgetary Quotation.
c.
Materials – Any physical item sold by
Appletree Property Services to fulfil the contractual obligation of the service
being provided.
d.
Provider – Appletree Property Services
e.
Purchaser – Any private individual or company
purchasing services and/or materials from Appletree Property
Services.
f.
Scope – All work involved in the contractual
agreement.
g.
Services – Any physical labour, design
activity, or home improvement solutions provided by Appletree Property
Services
h.
Site visit – A visit by Appletree Property
Services to the actual site where the work shall take place.
i.
Work – Services and/or Material requirements
as agreed in the final quotation.
II.
Responsibilities of the Provider – The Provider shall:
a.
Not provide any pricing or scheduling
information without first making a site visit.
b.
Endeavour to gather as much information as
possible on the initial site visit to formulate an accurate budgetary
quotation.
c.
Explain in detail the budgetary quotation to
the Purchaser for their complete understanding of the scope, cost,
and
time elements of the contract.
d.
Make any necessary changes to the budgetary
quotation based on the full understanding and agreement of the
Purchaser and provide the Purchaser with a final quotation or if no changes are
required, the budgetary
quotation will serve as the final quotation.
e.
Make every endeavour to quote materials
accurately; however, the Provider reserves the right to add unforeseen
material costs only after communicating such needs with the Purchaser.
f.
Make every endeavour to quote services
accurately; however, the Provider reserves the right to add unforeseen
services costs only after communicating such needs with the Purchaser.
g.
Strive to complete work as laid out in the
contract, with the understanding that severe weather conditions may
interfere.
h.
Provide quality in every aspect of his work.
i.
Give the Purchaser an invoice detailing all
services and/or materials delivered that fulfils the contractual obligation.
j.
Will complete all work to the customer’s
satisfaction.
k.
Ensure his work area is left as tidy as
possible during throughout the duration of the contract.
l.
Discard any rubbish or excess materials that
he produces by way of his working, for example, saw dust, grass
trimmings, paint cans, etc.
m.
Discard any rubbish created by the contractual
work being done, for example, replaced doors, broken windows,
old fencing, etc. for an additional charge to be used to pay the recycling
centre fees.
n.
Act at all times in a respectful and
professional manner and ensure that any subcontractors working on behalf of
the Provider act
the same. Any subcontractors not representing the Provider in a respectful and
professional
manner will result in the subcontractor being relieved of his duties.
III.
Responsibilities of the
Purchaser – The Purchaser shall:
a.
Provide any information needed to the Provider
that will assist him in formulating accurate budgetary and final
quotations.
b.
Allow timely access to the site areas
requiring work.
c.
Make available any materials they agreed to
purchase in the time frame agreed. Any delay could cause delay in
the agreed
to timescales for the completed work.
d.
Fully read and understand the budgetary and
final quotations, and the Terms and Conditions laid out herein.
e.
Agree to pay in full the contractual price as
stated on the detailed invoice within 10 days from the date of the
invoice,
regardless if there have been interim payments throughout the contract. Failure
to comply could result
in interest
being charged at a rate of 2% of the total contract each month thereafter.
f.
Shall not request any changes to the agreed
contract without allowing the Provider to re-scope the additional
effort.
g.
Not make use of any design supplied by the
Provider for themselves or any other contractor unless purchased for a
fee.
h.
Treat the Provider and any subcontractors
acting on their behalf respectably and professionally. Verbal and/or
physical abuse
will not be tolerated and will result in contract termination.
IV.
Validity of Quotation
a.
All services/labour costs and
times quoted on the budgetary and final quotations are valid for sixty (60)
days from date of quotation.
b. The
provider reserves the right to revisit any material costs on the budgetary and
final quotations after
thirty (30) day from date of quotation.
